We comply with the Children's Online Privacy Protection Act (COPPA). If we determine that a user is under 13 and has not provided parental consent where required, we will terminate access and delete any data in accordance with our Privacy Policy.
Our Games may offer optional in-app purchases ("IAP"), including virtual currency (e.g., gems, coins, tokens), cosmetic items (skins, themes), consumables (power-ups, boosters), and removal of ads or access to premium features.
All in-app purchases are processed exclusively through:
Elite Hexagone LLC does not directly collect or store payment card information. All billing, payment security, and transaction processing are governed by Google's or Apple's terms of service, respectively.

We strongly recommend that parents and guardians use the parental control and purchase restriction features available on their device and through Google Play / Apple App Store to prevent unauthorized purchases by minors. Elite Hexagone LLC is not liable for unauthorized purchases made by children on a parent's or guardian's account.
Prices for in-app purchases are displayed in your local currency as presented in the applicable app store. We reserve the right to modify pricing, discontinue items, or add new purchasable content at any time. We are not obligated to maintain any particular virtual item or content indefinitely.
Our Games are free to download and play. To support ongoing development and publishing, our Games may include advertisements served by third-party ad networks, including Google AdMob. By using our Games, you acknowledge and accept that:
All content within our Games — including but not limited to game code, artwork, animations, music, sound effects, characters, storylines, names, logos, trademarks, and user interface design — is owned by or licensed to Elite Hexagone LLC and is protected by copyright, trademark, and other intellectual property laws.
Your license to use our Games does not transfer any ownership of intellectual property to you. You may not use our trademarks, logos, or branded assets without our prior written consent.
User-Generated Content: If any of our Games allow you to create content (usernames, characters, drawings, etc.), you retain ownership of content you create, but you grant Elite Hexagone LLC a worldwide, royalty-free, perpetual, irrevocable license to use, display, modify, and distribute such content within the Game for operational purposes.

Violation of these rules may result in immediate suspension or permanent termination of your access to our Games, at our sole discretion, without notice or refund.
We may update our Games from time to time to fix bugs, add features, improve performance, comply with platform requirements, or change monetization. Updates may be mandatory (required to continue playing). By using our Games, you agree to receive such updates. We are not liable for any changes, discontinuation, or removal of features.
We reserve the right to discontinue any Game or App permanently. In such event, we will provide reasonable notice where practicable, but we are under no obligation to maintain our Games indefinitely. Virtual items purchased before discontinuation will not be refunded unless required by applicable law.
Our Games are distributed through the Google Play Store and Apple App Store. By downloading our Games from these platforms, you also agree to their respective terms of service:
In the event of a conflict between these Terms and the terms of your app store, the app store terms shall take precedence with respect to matters related to that store's services. Apple and Google are third-party beneficiaries of this EULA and may enforce it against you. Apple has no obligation to provide any maintenance or support for our Games.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that our Games will be compatible with all devices, free from viruses or other harmful components, continuously available, or that errors will be corrected. Your use of our Games is at your sole risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELITE HEXAGONE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO ELITE HEXAGONE LLC IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Elite Hexagone LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of our Games in violation of these Terms; (b) your violation of any applicable law; (c) your infringement of any third-party rights; or (d) any content you submit through our Games.
These Terms and your license to use our Games are effective until terminated. Your rights automatically terminate, without notice from us, if you fail to comply with any provision of these Terms. We also reserve the right to terminate or suspend your access to our Games at any time, for any reason, at our sole discretion, including but not limited to:
Upon termination, your license to use the Game immediately ceases, and you must delete all copies of the Game from your devices. Sections 3, 7, 11, 12, 13, 15, and 16 survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. Where mandatory local laws provide greater consumer protection, those laws shall apply to the extent required.
Before initiating any formal legal proceeding, you agree to contact us at contact@elitehexag.one and attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes within 30 days.
If informal resolution fails, any dispute arising from or relating to these Terms or our Games shall be resolved through binding arbitration in Sheridan County, Wyoming, under the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and binding. You waive your right to a jury trial and to participate in class actions.
YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
If you are located in the EU or UK, nothing in these Terms affects your rights as a consumer under applicable mandatory consumer protection laws, including the right to bring disputes before the courts of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

We may update these Terms at any time. When we make material changes, we will notify you by updating the "Effective Date" at the top of this document and, where practicable, by displaying an in-app notification. Your continued use of our Games after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using our Games.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elite Hexagone LLC regarding your use of our Games and supersede all prior agreements, communications, and proposals.
